LEGEND LAKE PROTECTION AND REHABILITATION DISTRICT

March 25, 2025

Commissioner Tom Ittner called the meeting to order 9am.

Commissioners Present:
Tom Ittner, Kristin Allen, Denise Gilane, Tom Moutvic via zoom, Jeremy Johnson, Robert Clark, and Gregg Malmstrom via zoom

Approval of the Agenda:

Tom Ittner made a motion to move item 12 up to item 3. Seconded by Jeremy Johnson. Motion carried

Permit Discussion with WDNR:

Tom Ittner said the public notice was published. The meeting on February 10, 2025 with the Tribe went well. A couple emails from the Tribe were received and they met with Jeremy Pyatskowit and answered them. The Tribe is interested in helping to possibly help with the purchasing of a harvester and supplying labor to man the operation of a harvester in lieu of herbicide treatment. The Tribe would also like to be involved in the comprehensive lake management plan that we are creating with the DNR. The district applied for the permit and received it from the DNR dated March 20, 2025. There are more requirements for the treatment this year outlined in the permit. Maddy Johanson explained the extra permitting is not new, it has been used on other lakes. Robert Clark pointed out the Legend Lake Bed is owned by the State of Wisconsin, not the Tribe. Jeremy Johnson said the DNR will take the Tribes concerns the same as any other property owner. They tried to set up a meeting with the Tribe earlier, but they did not want to. Jeremy Johnson said the plans were sent to the Tribe in December, and they not getting to their desk until February is their internal problem. The district cannot get it to the Tribe any earlier than December. It was suggested the Tribe set up the timeline. Jeremy said they can make suggestions, but they cannot set it. Tom Ittner pointed out that the DNR has already set the timeline. The Board is going to put together an outline of the timeline. There was a discussion about the treatment and the process.

Gregg Malmstrom said the LLPOA Lawsuit concerning dues on lots in trust is being taken on by the State supreme court.

There was a discussion on where they should send treatment notices for the Tribal lots.

Motion was made to Approve the minutes as presented by Denise Gilane and seconded by Bob Clark. Motion Carried.

Cash Balance Report:

Tom Ittner went over the cash balances & checking disbursement reports.

Approval of Disbursements:

Tom Ittner went over the disbursements report for February 23 through March 22, 2025. Denise Gilane made a motion to approve the disbursements report. Bob Clark seconded. Motion Carried.

Chairman’s Report:

Lake Manager:

Steve Schuh stated that the buoys will be put in the lake soon, then the docks in a few weeks. Everything is in good shape for the season.

Dam Inspector:

Tom Ittner said, Per Lisa Wilson, our Dam Inspector, that the Dams are in very good shape.

Communications:

Kristin Allen reported that the current logo of the LLPOA is not registered. Gregg Malmstrom will ask the LLPOA to put the Thunderbird logo back into play until a new logo can be agreed on.

Sanitary:

Jeremy said, cards to go out in a few weeks in 2 separate batches. People can also go on the county website to find out if they are up for the three-year inspection. Seasonal campers can get an extension on this inspection of up to two years max. Jeremy also said, the Sanitary Software is working great, and the pumpers are doing most of the input work which makes the process very efficient.

2025 Lake Management Plan:

Jeremy Johnson said he received the Aquatic Plant Management Permit for treatment in 2025 from the DNR dated March 20, 2025. Tom Ittner reported on what happened at the February 10, 2025, meeting with the Tribe’s Agriculture and Environmental Services committee. Eddie Heath of Onterra, LLC and Tom Ittner LLPRD were responding to an e-mail request of 1.14.2025 to Jeremy Johnson to answer the following questions:

  • What impacts does ProCellacor have on wild rice?
  • What studies are available that speak to the impacts of ProCellacor on other native plants and other aquatic species?
  • What are the breakdown products of ProCellacor and how long do they persist in the environment?
  • What studies are available that speak to the longevity of treatments? Eddie Heath took the lead with a slide presentation explaining what LLPRD is trying to do with our proposed treatment of 31.1 acres of EWM and Tom Ittner answered questions about procedures, guidelines and timelines that we follow per the DNR and Wis. Adm. Code Ch NR 107. There was significant discussion about upcoming events and timing. Pre-Treatment survey of treatment areas, riparian owner notification, purchasing chemicals and other notifications to mention a few.

Lake Fair:

Kristin reported that Letter are going out for vendors and the Tent is rented.

Town Ordinance #47 Re-Write Updates:

Jeremy took it to the public safety committee meeting who sent it to the Town Board, it was reviewed by the Board, but they had questions about procedures on citing by the boat patrol. It was sent back to the committee without a request for a public hearing. Will take longer than anticipated. The Responsible Boating Committee will re-write the synopsis that is handed out at the lodge currently.

New Business:

LLPRD Hourly Rates for Year 2025:

Tom Ittner and Tom Moutvic went over the LLPRD spreadsheet of employee hourly rates for the year 2025. The spreadsheet was passed around for Board members to review. There was some discussion. Jeremy Johnson made a motion to approve the hourly rates for the year 2025 as presented in the spreadsheet. Tom Ittner seconded. Motion Carried. There was no need to go into a closed session.
